1. Gamba AI services

Gamba AI provides operational software and AI-assisted services for sports facilities. Features may include phone, SMS, email, website chat, scheduling, class management, enrollment, attendance, staff management, lead management, knowledge tools, reporting, and administrative assistance.

Features may change as the platform develops. We may add, modify, suspend, or discontinue features when reasonably necessary.

2. Accounts and authorized users

Customers must provide accurate account information, protect account credentials, and limit access to authorized users. Customers are responsible for activity performed through their accounts and for assigning appropriate permissions to owners, managers, staff, coaches, and other users.

You must notify Gamba AI promptly if you believe an account or credential has been accessed without authorization.

3. Customer responsibilities

Customers are responsible for:

• Ensuring that information submitted to Gamba AI is accurate and lawfully collected.
• Obtaining required permission from customers, parents, guardians, athletes, staff, and other individuals.
• Reviewing schedules, prices, policies, messages, and other operational information for accuracy.
• Following applicable privacy, employment, consumer-protection, telecommunications, and youth-data requirements.
• Using AI-generated content and recommendations with appropriate human review.

4. AI-assisted features

Gamba AI may generate answers, drafts, summaries, recommendations, classifications, or suggested actions. AI output may occasionally be incomplete or inaccurate and should be reviewed before being used for important decisions.

Gamba AI does not provide legal, medical, accounting, employment, or other regulated professional advice. Customers remain responsible for final decisions and communications.

5. SMS messaging terms

People who contact Gamba AI LLC about its own software may voluntarily opt in to receive Gamba AI customer-care SMS messages. These messages include requested software demo coordination and replies to product or trial account support questions. Gamba AI LLC sends these messages under its own brand; this SMS program does not carry messages for sports facilities.

For this Gamba AI LLC program, recipients opt in by texting START to (516) 646-6855 after reading the instructions on our SMS opt-in page. A sports facility using Gamba AI may operate a separate SMS program for its own customers under that facility's brand.

Message frequency varies. Message and data rates may apply. Consent to receive SMS messages is not a condition of purchasing any product or service. Wireless carriers are not responsible for delayed or undelivered messages.

Reply STOP to opt out. Recipients who opt out will receive no further non-exempt messages unless they provide consent again. Reply HELP for assistance.

Gamba AI may modify or discontinue an SMS messaging program when reasonably necessary.

6. Acceptable use

You may not use Gamba AI to:

• Violate any law, regulation, carrier rule, or court order.
• Send deceptive, abusive, threatening, harassing, unlawful, or unsolicited communications.
• Contact individuals who have opted out or who have not provided required consent.
• Attempt to bypass security, permissions, usage restrictions, or platform safeguards.
• Upload malicious code or interfere with the operation of the platform.
• Use the platform to infringe another person's intellectual property or privacy rights.

7. Third-party services

Gamba AI may rely on third-party communications, hosting, database, payment, AI, analytics, and integration providers. Those services may be governed by separate terms. We are not responsible for outages or actions beyond our reasonable control.

8. Ownership

Gamba AI and its licensors retain ownership of the platform, software, designs, documentation, trademarks, and related intellectual property. Customers retain ownership of information they lawfully submit to the service.

Customers grant Gamba AI permission to process submitted information as necessary to provide, secure, support, and improve the contracted services.

9. Suspension and termination

We may suspend or terminate access when reasonably necessary to prevent security risks, unlawful activity, material violations of these Terms, nonpayment, harm to users, or disruption of the platform.

Customers may discontinue use of the services subject to any applicable subscription agreement or outstanding payment obligations.

10. Disclaimers

To the maximum extent permitted by law, Gamba AI services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, complete accuracy, or that every communication will be delivered.

11. Limitation of liability

To the maximum extent permitted by law, Gamba AI will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, or business interruption arising from use of the services.

12. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute not resolved informally will be handled in a court with appropriate jurisdiction in Michigan, unless applicable law requires otherwise.

13. Privacy

Information is handled according to the Gamba AI Privacy Policy.

14. Changes to these Terms

We may update these Terms when our services, legal obligations, or business practices change. The effective date above identifies the current version. Continued use after an update constitutes acceptance of the revised Terms.
